For what purposes and on what legal basis do we process your data?

  1. For the purpose of taking steps to conclude or to perform contracts, where you are a party to such a contract (applies to natural persons who are parties to a contract), on the basis of Article 6(1)(b) of the GDPR;
  2. If you are a representative or associate of an entity with which we cooperate, your personal data are processed on the basis of Article 6(1)(f) of the GDPR, where the legitimate interest consists in the proper performance of the contract binding us with your employer/principal and maintaining contact in connection with the cooperation. In such a case, if you do not contact us directly, your data may have been provided to us by the entity you represent or with which you cooperate;
  3. To enable e-mail communication with us (our employees and associates), to initiate contact with recipients, and to document arrangements made with contractors via electronic correspondence, on the basis of Article 6(1)(f) of the GDPR, where our legitimate interest consists in conducting correspondence and being able to demonstrate arrangements made in the course of such correspondence;
  4. To document concluded contracts and to settle them, on the basis of tax law provisions and the Accounting Act (including Articles 21 and 74(1) of the Accounting Act). Our organisation is also obliged to maintain archival documentation in paper form in order to document correspondence conducted with the Contractor and, in this respect, is subject to the provisions of the Act on the National Archival Resource and Archives. To the extent that legal provisions oblige us to process personal data, the legal basis for processing your data is Article 6(1)(c) of the GDPR;
  5. For purposes related to internal organisational and administrative activities aimed at ensuring the efficient functioning of our organisation, on the basis of our legitimate interest pursuant to Article 6(1)(f) of the GDPR;
  6. For the purposes of establishing, pursuing or defending claims, constituting the implementation of our legitimate interest, as well as for archival purposes, on the basis of Article 6(1)(f) of the GDPR.

We inform you that providing personal data is voluntary; however, it is necessary for the exchange of correspondence and the performance of the contract. Failure to provide data will result in the inability to conduct electronic communication and to conclude a contract. Personal data will not be subject to profiling.

To whom will we disclose your personal data?

We may disclose your personal data to other recipients entrusted with the processing of personal data on our behalf and for our benefit, including entities providing IT services, financial controlling services, and archival services. Your personal data may also be disclosed to law firms providing legal assistance to us or made available for inspection to verification entities such as certification bodies or statutory auditors. Your data will also be disclosed to authorised public administration authorities.

Your personal data will not be transferred to third countries or international organisations.

How long will we process your personal data?

Your personal data will be processed for the duration of the contract binding the parties, for the period necessary to pursue any potential claims, i.e. 3 years from the date of termination of the contract, as well as for archival and accounting purposes specified in separate legal provisions, such as tax law and the Accounting Act (in the case of accounting documents ? for a period of 6 years). In the case of archival documentation, data are processed for a period of 10 years from the end of the year in which the paper documentation was transferred to the archive.

What rights do you have?

  1. the right to access your personal data and to obtain a copy of the personal data being processed;
  2. the right to rectify inaccurate personal data;

  1. For the purpose of taking steps prior to entering into a contract or performing a contract to which you are a party (applies to natural persons being parties to a contract), pursuant to Article 6(1)(b) GDPR;
  2. If you act as a representative or associate of an entity with which we cooperate, your data are processed on the basis of Article 6(1)(f) GDPR, where the legitimate interest pursued is the proper performance of the contract between us and your employer or principal, as well as ensuring contact regarding cooperation. In such a case, if you do not contact us directly, your data may have been provided to us by the entity you represent or cooperate with, or obtained during the performance of services by PCBC
  3. To enable the exchange of e-mail correspondence (with our employees and associates), initiate contact with addressees, and document arrangements made with contractors via e-mail, pursuant to Article 6(1)(f) GDPR, where the legitimate interest pursued consists in maintaining correspondence and being able to demonstrate arrangements made during such correspondence;

Our organisation is also legally obliged to keep certain documentation in paper form for archival purposes in order to document correspondence with Clients and is subject in this respect to regulations concerning the national archival resource and archives. Where processing is required by law, the legal basis is Article 6(1)(c) GDPR;

? if you are the applicant, your personal data provided in the application submitted to PCBC will be treated as data necessary to prepare an offer for concluding a contract for verification/assessment/certification/extension of certificate validity, and providing them is required in order to determine and verify your identity and thus document the contract concluded in writing, on the basis of Article 6(1)(b) of the GDPR;

? if you are a person representing the applicant indicated in the introductory part of the application, your data will be processed in order to determine and verify your authorization to represent that entity (Article 6(1)(f) of the GDPR);

? if you are a person designated by the applicant for contact in connection with the submitted application, your data will be processed in order to properly examine the application and ensure ongoing contact during its consideration, on the basis of our legitimate interests consisting in the proper organization and communication within the application and offer preparation process, pursuant to Article 6(1)(f) of the GDPR;

In order to ensure the organization and conduct of the training from the ?Summer Knowledge Academy? series, in connection with the performance of a contract guaranteeing your participation in the event, your data are processed on the basis of Article 6(1)(b) of the GDPR.

For the purpose of ensuring the proper organization and course of the event, as well as for the possible establishment, investigation or defence of claims arising from the concluded contract, your data are processed on the basis of Article 6(1)(f) of the GDPR.

If you consent to receiving marketing content from PCBC, your personal data will be processed for the purpose of carrying out promotional and marketing activities concerning services offered by PCBC, on the basis of our legitimate interests in accordance with Article 6(1)(f) of the GDPR. You may withdraw your marketing consent at any time and object to the processing of your data for this purpose, which will be treated as withdrawal of marketing consent.

  1. For the purpose of taking steps to conclude or performing a contract for the organisation and delivery of training, where you are a party to such contract (applies to natural persons who independently pay for their training), on the basis of Article 6(1)(b) GDPR.
  2. In the case of individuals participating in training on behalf of the entity they represent, for the purpose of organising and conducting the training, including, where applicable, issuing certificates of participation. Your data are processed on the basis of Article 6(1)(f) GDPR, where our legitimate interest consists in the proper performance of the contract concluded with your employer/principal and in conducting the training process.
  3. If your personal data have not been provided directly by you, they may have been obtained from the entity sponsoring the training (e.g. your employer/principal).
  4. For the purpose of maintaining e-mail or telephone communication with you and initiating contact with recipients, as well as documenting arrangements made via electronic correspondence, on the basis of Article 6(1)(f) GDPR, where our legitimate interest consists in conducting correspondence and being able to demonstrate arrangements made in the course of such correspondence.
  5. PCBC is obliged to process data in connection with statutory accounting obligations, including maintaining accounting records that must contain data relating to invoices issued by PCBC and their attachments (which may include lists of trained persons), as well as documenting PCBC?s activities as a state organisational unit subject to the Act on National Archival Resources and Archives, and to the provisions of the VAT Act and the Tax Ordinance Act. The legal basis for such processing is Article 6(1)(c) GDPR.

Providing personal data is voluntary; however, it is necessary for participation in the training. Failure to provide data will result in the inability to participate in the training. Personal data will not be subject to profiling.

To whom will your personal data be disclosed?

We may disclose your personal data to other recipients entrusted with the processing of personal data on our behalf and for our benefit, including entities providing IT services, financial controlling services and archival services.

Your data may also be disclosed to competent public authorities where required by law.

If you participate in a certified training course, your data may be transferred to IQNET Association ? The International Certification Network. PCBC has concluded an agreement with IQNET. IQNET Association is a non-governmental, non-profit organisation based in Bern, Switzerland. The Association brings together partners, including PCBC, who provide selected training services meeting IQNET criteria. Under the aforementioned agreement, PCBC is obliged to transfer the data of participants in IQNet Academy certified training courses to IQNET Association.

Switzerland constitutes a third country within the meaning of GDPR.

The level of personal data protection in Switzerland has been recognised as adequate by the European Commission in its decision of 26 July 2000. The content of this decision is available here: European Commission Decision recognising the adequate level of data protection in Switzerland.

Your personal data will be collected and processed using tools provided by Meta Platforms Ireland Limited (https://www.facebook.com/privacy/policy?locale=pl_PL), LinkedIn Ireland Unlimited Company (https://pl.linkedin.com/legal/privacy-policy?) and Twitter International Unlimited Company (https://x.com/pl/privacy), which may operate servers located outside the EEA. Data transfers are carried out on the basis of standard contractual clauses concluded with the above entities, which are also participants in the EU-US Data Privacy Framework (DPF).

In addition, access to your data will be granted to PCBC employees responsible for taking photographs and publishing them online. The photographs will also be stored in digital form within PCBC?s internal IT systems. Therefore, access may also be granted to personnel employed by our IT service providers, who support us in securing and maintaining the continuity of these systems.

We do not plan to use these data for printed publications, such as albums or brochures.

How long will your personal data be processed?

Your personal data will be processed no longer than until the withdrawal of the consent you have given.

What rights do you have?

? withdrawal of consent for the processing of your image;

? access to photographs containing your image and obtaining their digital copies in a commonly used data format;

? rectification of incorrect personal data; however, this right does not include requesting retouching or alteration of your image in a photograph, although you may request the removal of a photograph which you believe is unsuccessful or presents your image in an unfavorable way;

? request for the erasure of data (right to be forgotten) in the circumstances provided for in Article 17 of the GDPR;

? request for the restriction of processing in the cases indicated in Article 18 of the GDPR;

? data portability, i.e. receiving from us the personal data you have provided in a structured, commonly used and machine-readable format for the period during which we process them, provided that this does not infringe the copyright of the person who took the photograph.

If you believe that your personal data are processed by PCBC unlawfully, you have the right to lodge a complaint with the supervisory authority (the President of the Personal Data Protection Office).

Documentation concerning authorization to process personal data will be stored for 20 years from the end of the year in which such authorization was withdrawn.

Documentation concerning the creation of user accounts and granting access rights to the Company?s ICT resources, including access to the FTP server, will be stored in the archive for 20 years from the end of the year in which such access rights were withdrawn.

5. Purposes and legal bases of data processing and obligation to provide data.

5.1. Legal Bases for Processing

7.2. PCBC Contractors (Processors)

PCBC outsources some of the processing of personal data of qualified personnel to other entities ? it entrusts them with the processing of such data. Entities acting on behalf of PCBC include entities providing IT services, mailroom services, financial controlling services, archiving services, data deletion, as well as legal services. Outsourcing these activities does not mean that the above-mentioned entities will always gain access to your data, but according to the service contract, they can obtain such access, which is why PCBC informs about such a possibility.

After this period, if no separate contract for specific work has been concluded, the documentation in paper form will be stored for 10 years from the end of the year in which such agreement was terminated, in accordance with the regulations on national archival resources and archives in force in the Company.

Documentation concerning the authorization of your authorization to process personal data will be stored for 20 years from the end of the year in which such authorization was withdrawn.

Documentation regarding the creation of an account and granting authorizations to the Company's ICT resources, i.e. to the FTP server resources, will be stored in the archive for 20 years from the end of the year in which the authorization to the ICT resources was revoked.

If, in the performance of the agreement concluded now, an agreement is signed with you in the future with PCBC for participation in the medical device evaluation process, then the data provided by you will be stored for the period necessary to determine that the medical device evaluation process carried out with your participation was carried out by appropriately qualified personnel.


10. Rights of individuals in relation to the collection of their data

The rights of individuals in connection with the collection of their data may be limited or excluded by the provisions of the GDPR, e.g. the right to object to the processing of data if the objector is subject to proceedings to pursue claims against him or her


10.1. request access to your personal data,

As a general rule, it consists in obtaining a copy of the data processed about the personal data.

The first copy of the data is free of charge, for any subsequent copies the controller may charge a reasonable fee resulting from the administrative costs. If the data subject requests a copy by electronic means, and unless otherwise stated, the information shall be provided by electronic means which are generally used.

In addition, such a person may request information on the conditions under which his or her data is processed.

10.2. Request rectification

Additional clarification The right to request rectification is governed by Article 16 of the GDPR

If you believe that any information about you is incorrect or incomplete, please submit a request for rectification in the manner set out in the section Exercising Your Rights. PCBC will promptly correct such information or delete outdated and redundant data.

10.3. request erasure of your personal data

Additional clarification The right to request the deletion of your data (right to be forgotten) is defined in Article 17 of the GDPR. In accordance with Article 17(1)(c) of the GDPR, PCBC S.A. may refuse to delete data even if the data subject objects to processing under Article 21(1) of the GDPR, due to the fact that, in PCBC S.A.?s assessment, there are overriding legitimate grounds for processing.

10.4. request the restriction of the processing of your personal data.

Additional clarification According to the GDPR, "restriction of processing" means marking the personal data stored in order to restrict its future processing.

The right to restriction of processing is set out in Article 18 GDPR

10.5. Request data portability

Additional clarification Pursuant to the GDPR, a data portability request means the right to receive the personal data provided to controller in a structured, commonly used and machine-readable format and to request the transmission of such personal data to another personal data controller, without hindrance from controller and subject to its own confidentiality obligations.

The right to data portability is defined in Article 20 of the GDPR

10.6. Right to withdraw consent to data processing

In the case of processing your personal data for the above-mentioned purposes, this right does not apply (we do not collect personal data based on your consent)

Additional clarification According to the GDPR, "consent" of a data subject means a free, specific, informed and unambiguous indication of the data subject's will, by which he or she consents to the processing of personal data concerning him/her, in the form of a statement or a clear affirmative action

10.7. Right to object to processing

Additional clarification The right to object to data processing is set out in Article 21 GDPR

You have the right to object ? for reasons related to your particular situation ? to the processing of your personal data only in those cases where the purpose of data processing is based on the legitimate interests of PCBC ? i.e. those indicated in section 5.2

10.8. Exercising Your Rights

To exercise the above rights, you may send an e-mail to the following address: iod@pcbc.gov.pl or send a notification in writing to the address of PCBC's registered office indicated in point 2.2

10.9. Right to lodge a complaint with a supervisory authority

If you become aware of unlawful processing of your personal data by PCBC, you have the right to lodge a complaint with the supervisory authority competent for the protection of personal data, i.e. the President of the Office for Personal Data Protection.

11. Automating decision-making, including profiling

PCBC does not intend to perform operations on your data that would lead to automated decision-making, including profiling, which would produce legal effects or similarly significantly affect the data subject.

Additional clarification Automated decision making is a decision that has been made through technical means without human intervention.

According to the GDPR, "profiling" means any form of automated processing of personal data that involves the use of personal data to evaluate certain personal aspects of a natural person, in particular to analyse or predict aspects relating to that natural person's performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements
